Before the project is published on the platform, you may withdraw from the contract in accordance with the contractual provisions. In this case, a withdrawal fee becomes payable. The amount is specified in the General Terms and Conditions of Engagement and is subject to indexation.
When does the withdrawal fee apply?
The withdrawal fee also applies if CONDA Capital has to terminate the project for a material reason attributable to you.
This includes, in particular, a failure to fulfil your cooperation obligations, for example if requested documents or information are not provided despite being requested.
What applies after the offering has been published?
If the project has already been published on the platform and opened for subscription at the time of cancellation, all fees accrued under the offer up to that point become payable in addition to the withdrawal fee.
There is no ordinary right of termination. Either party may terminate the contract only for material cause.
What does “withdrawal fee” mean?
The withdrawal fee is a contractually agreed lump-sum payment for early withdrawal from the contract where CONDA Capital is not responsible for the termination. It does not constitute damages and applies irrespective of how far the project has progressed at the time of cancellation.
