What if annual financial statements or reports are missing for a prolonged period?
If a company fails to provide reports or financial statements for an extended period, a reminder process is automatically initiated.
This process serves to remind the issuer of their contractual reporting obligations and to urge them to publish the missing documents.
In some cases, however, companies are unwilling or unable to submit the reports on time. Unfortunately, for older contracts, there are no legal options available to enforce reporting retrospectively.
Good to know: CONDA has responded to these recurring issues. New contracts now incorporate more binding reporting obligations and sanction mechanisms to improve the quality of information for investors in the long term.
