What is a registry operator for electronic securities?
The registry operator maintains a register of tokenised securities (crypto-securities) and is responsible for handling them confidentially, ensuring their integrity, and guaranteeing the availability and authenticity of the data.
In Germany, a registry operator is required by law when crypto-securities are issued. The issuer usually selects the registry operator. We work primarily with Smart Registry GmbH. Smart Registry GmbH grants investors and any person in whose favour a right or restriction is entered in the crypto-securities register access to the register in accordance with legal requirements.
The registry operator holds a provisional licence to maintain a crypto-securities register in accordance with Section 65(2) of the German Banking Act (KWG) and offers the maintenance of such a register in which crypto-securities within the meaning of Section 4(3) of the German Electronic Securities Act (eWpG) may be recorded.
