What is the current status of an insolvency?
In the event of insolvency, the process for subordinated loans differs from that for ordinary claims: claims arising from subordinated loans may only be filed in insolvency proceedings if the insolvency judge expressly orders this.
However, this rarely happens. In most cases, therefore, insolvency unfortunately means a complete loss of the invested capital (total loss).
CONDA Capital itself cannot act as the investors’ representative in such cases, as the contract was concluded directly between the investor and the company.
